Em uma sociedade democrática, onde os princípios da liberdade e da igualdade são adotados, o princípio majoritário fornece um critério justo para identificar os pontos de vista que devem prevalecer ao final de processos coletivos de tomada de decisão. As regras da unanimidade e da maioria (...) qualificada são insuficientes para corrigir as alegadas injustiças produzidas pelo princípio da maioria, em virtude das dificuldades de efetivação que possuem, da ausência de real proteção às minorias e das contradições internas que apresentam. Embora seja possível imaginar um sistema jurídico no qual o princípio majoritário viabilize a existência de uma tirania ou ditadura da maioria, presumir que, nesse contexto, os juízes necessariamente formarão o grupo de defensores dos direitos das minorias é realizar uma aplicação seletiva do princípio da igualdade. In this paper, I distinguish two senses of the word ‘essence’ both of which figure prominently in recent analytic metaphysics. To disambiguate, I adopt the terminology of ‘modal essence’ (for how a thing metaphysically must be) and ‘whatness essence’ (for what a thing is). With the help of this terminology, I address Kit Fine’s charge that modal metaphysics in the framework of Saul Kripke’s Naming and Necessity proffers an incorrect conceptual analysis of whatness essence. The scarcity of vital organs has prompted several calls to either modify the dead donor rule or interpret it more broadly. Given its symbolic importance, however, the rule should be changed only cautiously.

Habitual actions unfold without conscious deliberation or reflection, and yet often seem to be intelligently adjusted to situational intricacies. A question arises, then, as to how it is that habitual actions can exhibit this form of intelligence, while falling outside the domain of paradigmatically intentional actions. Call this the intelligence puzzle of habits. This puzzle invites three standard replies. Some stipulate that habits lack intelligence and contend that the puzzle is ill-posed. Others hold that habitual actions can exhibit intelligence because (...) they are guided by automatic yet rational, propositional processes. Others still suggest that habits guide intelligent behaviour without involving propositional states by shaping perception in action-soliciting ways. We develop an alternative fourth answer based on John Dewey’s pragmatist account of habit. We argue that habits promote intelligent behaviour by shaping perception, by forming an interrelated network among themselves, and by cooperating with the environment. (shrink)

Advance directives such as living wills are attractive in that they give us a sense of control over our futures. But they also tend to obscure conflicts between a patient's competent wishes and later, incompetent interests. They allow caregivers to avoid evaluating quality of life in assessing the best interests of incompetent patients.

Ethical and legal traditions recognize prenatal duties to avoid harm to offspring. However, applying the harm principle to pregnancy requires a careful balancing of a baby's welfare with a pregnant woman's interest in liberty and bodily integrity. In the case of maternal PKU the mother can prevent harm to her baby by returning to the admittedly unpleasant diet that prevented her from being retarded. Informing, counseling, and access to medical care should be the primary policy. Seizures and forced treatment cannot (...) be justified in this case, and only rarely in other situations. (shrink)

The U.S. and U.K. models of corporate social responsibility (CSR) are relatively well defined. As the phenomenon of CSR establishes itself more globally, the question arises as to the nature of CSR in other countries. Is a universal model of CSR applicable across countries or is CSR specific to country context? This article uses integrative social contracts theory (ISCT) and four institutional factors – firm ownership structure, corporate governance, openness of the economy to international investment, and the role of civil (...) society – to examine CSR in Singapore, Turkey, and Ethiopia. Field research results illustrate variation across the institutional factors and suggest that CSR is responsive to country differences. Research findings have implications for consideration of the tradeoff between global and local CSR priorities and practices. (shrink)

Retaliation against whistleblowers is a well-recognized problem, yet there is little explanation for why uninvolved peers choose to retaliate through ostracism. We conduct two experiments in which participants take the role of a peer third-party observer of theft and subsequent whistleblowing. We manipulate injunctive norms and descriptive norms. Both experiments support the core of our theoretical model, based on social intuitionist theory, such that moral judgments of the acts of wrongdoing and whistleblowing influence the perceived likeability of each actor and (...) ultimately influence intention to ostracize each actor and indicate more willingness to ostracize the whistleblower than the wrongdoer. When we vary norms for the wrongdoing in Experiment 1, we find that descriptive and injunctive norms indirectly influence intentions to ostracize both the wrongdoer and whistleblower. These relationships are serially mediated by the observers’ moral judgments of the act and likeability of the actor. When we vary norms for whistleblowing in Experiment 2, the injunctive norm manipulation affected moral judgment of the action of whistleblowing, and we do not observe any other significant effects of the norm manipulations on moral judgments of the actions of wrongdoing or whistleblowing. The present and future rapid increase in the hospital population of geriatric patients is discussed with particular reference to the problem of advanced brain degeneration. The consequences of various clinical management options are outlined and it is suggested that extreme attempts either to preserve or terminate life are medically, morally and socially unacceptable. The preservation of life in senile patients has important economic consequences. In achieving a decision on the medical management of patients with advanced brain decay it is suggested (...) that substantial help would be derived from: knowledge of the previously declared wishes of individual patients; improvements in geriatric assessments; broader consultation with relatives, and greater use of inter-disciplinary discussion in the preparation of criteria for terminating medical efforts to maintain survival. Members of the transforming growth factor beta (TGFβ) family are pleiotropic cytokines with key roles in tissue morphogenesis and growth. TGFβ1, TGFβ2 and TGFβ3 are abundant in mammalian reproductive tissues, where development and cyclic remodelling continue in post‐natal and adult life. Potential roles for TGFβ have been identified in gonad and secondary sex organ development, spermatogenesis and ovarian function, immunoregulation of pregnancy, embryo implantation and placental development. However, better tools must now be employed to map more precisely essential functions and (...) the regulatory networks governing their activity. Gene ablation and transgenic models are expected to provide novel insights into distinct physiological activities for each TGFβ isoform in normal reproductive function and reproductive pathologies. It is also necessary to consider the mechanisms controlling TGFβ activation from latent precursor forms, and receptor and binding protein expression. Smad intracellular signalling circuitry and modulation by environmental stimuli through cross‐talk with other signal transduction pathways will further constrain TGFβ action. This review examines existing evidence for TGFβ1, TGFβ2 and TGFβ3 regulation of male and female reproductive biology, and highlights prospects for future research. This paper starts by considering an argument for thinking that predictive processing (PP) is representational. This argument suggests that the Kullback–Leibler (KL)-divergence provides an accessible measure of misrepresentation, and therefore, a measure of representational content in hierarchical Bayesian inference. The paper then argues that while the KL-divergence is a measure of information, it does not establish a sufficient measure of representational content. We argue that this follows from the fact that the KL-divergence is a measure of relative entropy, which can (...) be shown to be the same as covariance (through a set of additional steps). It is well known that facts about covariance do not entail facts about representational content. So there is no reason to think that the KL-divergence is a measure of (mis-)representational content. This paper thus provides an enactive, non-representational account of Bayesian belief optimisation in hierarchical PP. (shrink)

In the fourth-century Greek theologian Basil of Caesarea is found a discussion of the signification of proper names, which appears to pick up some points from earlier ideas about language. He undertakes an analysis of proper names in response to his theological opponents. I will argue that Basil presents a theory which in some respects anticipates modern description theories.
